That the Council of General Synod adopt the following policy regarding the copyright of the liturgical resources of the General Synod of the Anglican Church of Canada:
i) That the General Synod of the Anglican Church of Canada (henceforth the General Synod) retain copyright to all its liturgical texts.
ii) That parishes, dioceses, chaplaincies, religious orders, and other institutions of the Anglican Church of Canada have permission to print, free of charge for use only in their institutions and not for sale, liturgical texts copyright by the General Synod, provided they observe whatever reasonable copyright limitations may be prescribed by the General Synod, and provided they seek permission to use texts copyright by other parties and included in General Synod texts.
iii) That parties and organizations other than parishes, dioceses, chaplaincies, religious orders, and institutions of the Anglican Church of Canada must seek permission to use General Synod texts, and that the General Synod may determine the conditions, and charge a fee or royalty, for such use.
iv) That the General Secretary act as custodian of liturgical texts copyright by the General Synod, and that ABC Publishing (Anglican Book Centre) or a General Synod agent appointed by the General Secretary act of administrator of the copyright in consultation with the General Secretary and the staff of Faith, Worship and Ministry.
v) That the General Synod or a designated agent such as ABC Publishing (Anglican Book Centre) may charge a reasonable price to produce and sell print or electronic resources delivering liturgical texts copyright by the General Synod, but may not charge Anglican parishes, dioceses, chaplaincies, religious orders, and institutions for the duplication of those texts provided that they comply with terms outlined above. That the Council of General Synod transfer in trust those copyrights held by the General Synod of the Anglican Church of Canada to the Primate and recommend to the Primate that the Anglican Book Centre Publishing be the licensed agent.
Chancellor Ronald Stevenson noted that advice from solicitors was needed to deal with the details of how the rights would pass from one Primate to the next. Concern was also expressed regarding exposure of the Primate or his successor to potential claims.

"Bravo ! It's about time that the Canadian church got on board with relaxing its copyright control over the liturgy. Other churches have had their liturgies in the public domain for some time now. These texts are not primarily sources of income; they are the heart of our churches' spiritual lives. They shouldn't be up for sale. There are other ways to protect the church's right to be acknowledged as the author without controlling the right to make copies".

The author, Publishing Manager for ABC Publishing, talks about the advances in copying and reproducing texts (including music and hymns) which have taken place in the last fifty years or so. Now when technology makes reproducing text so much easier there has grown a concomitant need to determine copyright and to spend time obtaining copyright permission and paying fees. Today, licensing is becoming a popular way to make music and text available. Later this year "ABC Publishing through ABC Bookstore plans to launch a licensing program for Canadian Anglican liturgy. Soon Anglican churches will be able to access authorized liturgies from CD and to copy and portion of any service available through the licensing program. This will make it easy to insert portions of services into bulletins or to customize service booklets for the pews. With Anglican Liturgy Licensing, churches will no longer need to obtain permission from copyright owners listed in liturgical texts, such as `The Book of Alternative Services', or from General Synod. Through the low licensing fee based on attendance, copyright owners will be compensated and General Synod will be enabled to continue providing liturgical resources for the church in the future. A fee of $100 for up to 50 parishioners, and $50 for each additional 50 parishioners, is being proposed".

The Committee recommended the following action:
That the resolution of the Executive Council of the United Church requesting the use of portions of the new hymn book be approved and sent to NEC for its endorsement with the further stipulation that when approval of the Anglican Church of Canada is sought, the General Secretary's office be empowered to confirm requests.
Note: The following is the policy of the United Church of Canada:
The Executive of the General Council has approved a policy "by which the United Church would grant to any other Church or religious body permission to copy without charge or royalty, any liturgical or devotional material whose copyright is owned by the United Church of Canada, excepting that such permission would not include the right to copy an entire publication or major part thereof.

That this National Executive Council receive Occasional Celebrations, and
request the Anglican Book Centre to publish it when final copy editing and the negotiation of permission to use copyrighted materials have been completed, and
commend it to the church for use where authorized by the diocesan bishop, and
agree that the terms of the copyright provide for parishes and congregations to copy material for use, provided that they have already purchased a copy of the book. CARRIED #51-11-91

That the following recommendations be referred to the Administration and Finance Committee:
"(e) that copyrights be held by a corporate body of trustees, specially appointed by the Executives of our two Churches;
(f) that the secretary of the Joint Committee be the person authorized to secure permissions for the use of material under copyright;
