That the Council of General Synod approve amendments to Regulation 8.5 of the Lay Retirement Plan effective January 1, 2003.
Renumber the current Regulation 8.5 as 8.5(a) and add a new section (b).

Where a Member's employment by a Participating Employer terminates upon the Member becoming an employee of another Participating Employer, the Member's Active Service shall be deemed not to have terminated.

Archbishop Morgan drew attention to Section 1.4 of the report, which read:
"The Pension Committee is recommending to the Council of General Synod that prior to approving the resolution, which is being presented by EcoJustice Committee with respect to Socially Responsible Investment Procedures, that it be referred to the Pension Committee for consultation and to report back to the next meeting of COGs."
Ms. Mason, who is retiring after 40 years of service to the Pension Plan, extended best wishes to Council and acknowledged that she will miss everyone. She has no doubts that the right choice was made when Council appointed Ms. Judy Robinson to be her successor.
RESOLVED That Canon IX, Part 3, be amended as follows:
(1) To strike out the word "three" in clause (e) of subsection (1) of Section 23, and substitute the word "two" so that such clause will read as follows:
"(e) Two members of the Board of Finance appointed by the Board."
(2) To strike out the word "Two" in clause (f) of subsection (1) of Section 23 and substitute the word "one" so that such clause will read:
"(f) The General Secretary and one member of the Executive Committee of the Department of Missions."
(3) To add the following as clause (i):
"(i) Four members, not necessarily members of the Synod, appointed by the Budget Committee at its first meeting following a Session of the Synod."
(4) To add to subsection (4) of Section 23 the following words "or its Executive Committee", so that it will read:
"(4) The members of the Committee shall be entitled to receive their travelling expenses when attending meetings of the committee or its Executive Committee."
(5) To add a new subsection to Section 23 to read as follows:
"(5) The Committee at its first meeting following a session of the Synod shall appoint an executive committee consisting of the chairman, the secretary, and eight other members and such executive committee shall carry on the work of the Budget Committee between regular meetings thereof and shall act for the committee in cases of emergency and in matters referred to it by the committee.
That Canon IX and the Regulations governing the Lay Retirement Plan be rescinded and replaced with the revised Canon IX and the Regulations governing the Lay Retirement Plan as in the form attached. CARRIED Act 67

CANON IX
LAY RETIREMENT PLAN
1. The Lay Retirement Plan is established to provide Pensions for lay employees of the Church who are not members of the General Synod Pension Plan.
2. There shall be a fund established in conjunction with the Plan under a written trust agreement in Canada, which fund shall be designated as "The Lay Retirement Fund", for the purpose of providing benefits in accordance with this Canon and the Regulations. The Lay Retirement Fund shall be composed of the monies received from the Participating Employers and Members, transfers and other amounts for provision of Plan benefits together with interest, dividends, earnings, accumulations and accretions, less the amounts expended in the payment of Plan benefits and the expenses of administration of the Plan and the Lay Retirement Fund.
That this General Synod approve the amendments to Canon IX as approved by the Council of General Synod by deleting the scored portions and adding the underlined portions as shown on the attached copy of the Canon. CARRIED Act 43

That in line 2 of Subsection 2 of Section 4 (Duties of the Honorary Treasurer) of Canon IX (Handbook, p.114) the words, "annual session of the Executive Council and at each," be deleted, so that said Subsection 2 will read:

(1) To amend section (2) (Powers) of Canon IX (Finance) Part I, p.97, by striking out all words after the word "security" in the second last line, so that the section will read as follows:
(1) Subject to the provisions of any legislation affecting the investment of trust funds or the funds held by the Board, and subject to the provisions of Part II, the Board shall have the management and control of the Consolidated Trust Fund and of all property, securities and moneys, which now are or which may hereafter become vested in, held by, or entrusted to the General Synod for management or investment, and may make such lawful investments of the same in such sums and at such rates of interest and on such terms as the said Board shall in its discretion deem advisable, provided that, except those securities set out in subsection (a) of Section 63 in Chapter 46 of the Act of the Parliament of Canada (22-23 George V) dealing with Canadian or British insurance companies, or in amendments thereto, no more than $50,000 shall be invested in any one security.

REGULATION 2 - ELIGIBILITY & MEMBERSHIP
2.1. All lay employees of a Participating Employer shall be Members except as provided under sections 2 and 3 of this Regulation.
REGULATION 3 - CONTRIBUTIONS
4.(a) in respect of a Member who is in receipt of Pension after the December 31 coincident with or next following the Member's attainment of the age of {sixty-nine} years .
REGULATION 4 - RETIREMENT
4.3 Member who continues in Active Service subsequent to the Member's Normal Retirement Date shall receive a Pension calculated in accordance with Regulation 5 accruing on the first day of the month following the Member's retirement date. For purposes of the Plan, the Member's retirement date must be no later than the December 31 coincident with or next following the Member's attainment of the age of {sixty-nine} years .
