That Second Reading be given to the resolution that section 11 of the Declaration of Principles be amended by the addition after section d) of the following section:
e) Amendments on Second Reading at Synod
i) Where a proposed change to the Declaration of Principles (other than to s.6,7 or 7A thereof) or to a Canon dealing with doctrine, worship or discipline has been
a) passed at one session of the General Synod,
b) referred for consideration to all diocesan and provincial synods, and
c) brought before a second session of the General Synod for consideration,
it shall be in order for the General Synod to adopt any amendment to the proposed change which would have been in order when the proposed change was considered at the first session of the General Synod and the proposed change shall take effect if passed by the required majority at the second session with or without such amendment.
ii) Where a proposed change to sections 6,7 or 7A of the Declaration of Principles has been:
a) passed by the required majority at one session of the General Synod,
b) referred for the consideration of all diocesan synods,
c) referred for consent to all provincial synods, and
d) brought before a second session of the General Synod for consideration,
it shall be in order for the General Synod to adopt any amendment which does not alter the proposed change in any substantive way but which merely improves the clarity or form of the proposed change and the proposed change shall take effect if passed by the required majority at the second session with or without such amendment. That, while it is evident that the variety of teaching and practice with the Church of England is rooted deeply in its history and contributes to the fullness and richness of its life, which we all share and treasure, nevertheless we appeal to all to refrain from unduly straining the limits of the wide tolerance which is given to us in the Book of Common Prayer, and to help forward the movements towards agreement between various schools of thought and practice in the Church by every means in their power. CARRIED in both Houses.

Friendly Amendment
A suggestion from the Rev. Jean Brenton-Hickman to change the word ‘consistent’ to “not in conflict” was accepted by the mover and seconder. The resolution now reads:
- That this General Synod resolves that the blessing of same-sex unions is not in conflict with the core doctrine of The Anglican Church of Canada.
Mr. David Embury requested that the Primate announce the vote totals for this amended resolution and this was agreed.

Secondedn by: Ms. Carol Summers That the agenda be revised to permit Synod members to continue debating this resolution. DEFEATED
Debate resumed on this resolution and the Primate urged members to be brief and, with the overwhelming agreement of Synod members, future speakers were limited to two minutes.
The amended resolution reads:

Bishop Donald Phillips spoke about a procedural resolution he wanted to present and, after consultation with the Assessors, the Primate advised that the resolution to close the debate took precedence over a procedural resolution.
The above resolution was then put and DEFEATED

Bishop Michael Ingham proposed a friendly amendment which was accepted by the mover and seconder – i.e. …not in conflict with the core doctrine of the Anglican Church of Canada in the sense of being credal.
The motion now reads:
- That this General Synod resolves that the blessing of same-sex unions is not in conflict with the core doctrine of The Anglican Church of Canada in the sense of being credal.
Second Amendment to the Amendment as Amended

That Resolution A134 be amended by:
1) Deferring consideration of section 2 until the meeting of General Synod in 2007; and during the period of deferral:
Request that the Primate ask the Primate's Theological Commission to review, consider and report to the Council of General Synod, by its spring 2006 meeting, whether the blessing of committed same sex unions is a matter of doctrine.
That on receipt of such a report, the Council of General Synod distribute it to each province, diocese and the House of Bishops for consideration.
Archdeacon Karl McLean rose on a point of order to question if this was a new motion. The chair ruled that in fact the amendment was a motion to defer.

The revised resolution was presented.
That first reading be given to the Resolution that section 11of the Declaration of Principles be amended to read as follows:
11. Amendments; Enactment of Canons
a) Amendments to the Declaration of Principles
- i) The Solemn Declaration of the Declaration of Principles belongs in a particular historic context and therefore cannot be altered or amended.
- ii) An amendment to the Declaration of Principles can be considered only when a majority of each Order is present at the session of the General Synod.
- iii) Subject to subsection iv), an amendment to the Declaration of Principles shall take effect when passed by a two-thirds majority in each Order.
- iv) An amendment to sections 6, 7 and 8 of the Declaration of Principles shall take effect only when the General Synod has adopted it in the manner prescribed in subsection iii), and the synods of each of the ecclesiastical provinces of the Anglican Church of Canada have consented to it.
- v) The synod of an ecclesiastical province of the Anglican Church of Canada shall be deemed to have consented to an amendment to section 6, 7 or 8 of the Declaration of Principles adopted by the General Synod if no resolution proposing consent to the amendment has been voted upon in the provincial synod before the expiration of 3 years from the date the amendment was passed by the General Synod.
- vi) Where a proposed amendment to the Declaration of Principles has been defeated by the General Synod, or where an amendment to section 6, 7 or 8 of the Declaration of Principles passed by the General Synod has not taken effect pursuant to subsection iv), the proposed amendment may be introduced again at any subsequent session of the General Synod.
b) Amendments to the Constitution
- i) An amendment to a section of the Constitution which has its origin in the Declaration of Principles must be consistent with the Principle concerned.
- ii) An amendment to the Constitution of the General Synod shall take effect when passed by a two-thirds majority of each Order voting at a session of the General Synod.
c) Canons and Amendments to Canons
- i) All Canons dealing with doctrine, and amendments to such Canons, shall take effect when passed by a two-thirds majority in each Order at two successive sessions of the General Synod, the Canon or amendment proposed having been referred for consideration to diocesan and provincial synods, following the first approval of the General Synod.
- ii) All Canons dealing with matters other than doctrine or amendments to such Canons, shall take effect when passed by a two-thirds majority of the Order of Bishops, and of the Orders of Clergy and Laity voting together.
d) Amendments to the Rules of Order and Procedure
- An amendment to the Rules of Order and Procedure shall take effect when passed by a two-thirds majority of the Order of Bishops, and of the Orders of Clergy and Laity voting together.
e) Amendments on Second Reading at Synod
- i) Where a resolution proposing a Canon dealing with doctrine or an amendment to such a Canon has been:
-- a) passed at one session of the General Synod,
-- b) referred for consideration to all diocesan and provincial synods, and
-- c) brought before a second session of the General Synod,
-- it shall be in order for the General Synod to adopt any amendment to the resolution which does not alter the resolution in any substantive way but which merely improves the clarity or form of the resolution.
- ii) A resolution amended pursuant to subsection i) shall take effect if passed by the required majority at the second session notwithstanding the amendment.

In regard to our message U-8 and this message of the Lower House, L-47, this Upper House would advise the Lower House that our consideration of this matter was not concluded, and in view of this and and of Section 7, subsection 2(h) of the Declaration of Principles, we desire that our earlier message U-8 and the action of the Lower House in respect to it be rescinded, and that the subject be left open for further consideration.

That Provincial Synods be requested to consider substituting assent to the Solemn Declaration adopted by the first session of the General Synod in 1893 (as Printed in the Book of Common Prayer) for assent to the Thirty-Nine Articles as a requirement for Candidates for Holy Orders and for clergy about to be licensed.
The Thirty-Nine Articles retain their place as comprising one of the historic documents of our Anglican tradition, are explicitly referred to in the Solemn Declaration.

Archbishop Jackson asked, "Does Section 9 of the Declaration of Principles require that major changes in doctrine and practice decided upon by General Synod require approval of the Provincial Synods before being effected ?"
In response the Assessors offered the following opinion:
"Archbishop Jackson raised the question of the effect of Section 9 of the Declaration of Principles. This section refers to Sections 6 and 7 of the Declaration. Section 6, subject to Section 7, defines the legislative jurisdictions of General Synod. Section 7 defines the legislative jurisdictions of Provincial Synods. Section 9 reads, `... Except insofar as the provisions of Sections 6 and 7 are the same as the legislation now in force, the said Sections shall not come into force in such ecclesiastical Province until approved by the Provincial Synod thereof.'
"The Assessors are informed that Section 9 was introduced into the Declaration when delegates from the ecclesiastical Provinces then in existence in Canada met in 1893 to join in the Declaration of Principles and authorize the creation of General Synod. The distribution of jurisdictions set out in Sections 6 and 7 between General Synod and Provincial Synods involved the surrender by the Provinces to General Synod of the powers set out in Section 6. This surrender required confirmation by the Provincial Synods then in existence -- those of Rupert's Land and Canada. Section 9 deals with that confirmation. The word `now' in Section 9 referred to the original date of the Declaration of Principles, in 1893.
"The Assessors are informed that the required confirmation was given by the two Provincial Synods in 1893. That being so, no further confirmation is necessary. Archbishop Jackson's question was directed to the problem whether legislation of each session of General Synod under the authority of Section 6 of the Declaration requires confirmation by each Provincial Synod before it can come into effect in each Province, respectively. On the understanding that such confirmation was given immediately following the adoption of the Declaration by the two then existing Provincial Synods, the Assessors agree that the legislative jurisdiction of General Synod was thereby permanently established and no Provincial confirmation of current legislation of General Synod enacted under the authority of Section 6 of the Declaration is now necessary.
"It is noted that the Ecclesiastical Provinces of Ontario and British Columbia are the creations of General Synod, and this problem did not relate to their Synods.
"It would appear that the provisions of Section 9 of the Declaration are spent and might well be dropped.
"This opinion is concurred in by all the Assessors."

The Bishop of Toronto, Chairman of this Committee, asked permission to present a report of the Committee. Permission being given, the Bishop of Toronto presented the following report.
Montreal, PQ, September 14th, 1934.
Your Committee has met twice.
At the first meeting the Secretary was asked to examine the work of the Committee since its inception.
Your Committee finds that the Committee was first set up in 1893. No business has ever been referred to it. There has never been any clear understanding as to the exact function of the Committee. Few reports have ever been made to the Synod.
The Appendix to the Prayer Book recommended in 1896 has been provided for in the revised Prayer Book.
Your Committee recommends that in view of the history of the Committee, it be discontinued. Derwyn Toronto, W.H. Vance.
