The Faith and Worship Ministry Committee presented the following motion in Document #006-16-11-06:
That this Council of General Synod bring the following procedural resolution to the General Synod of 2007: (one to be chosen after discussion groups at the Council and the advice of the Chancellor)
Option One: A resolution declaring that matters of non-core doctrine (in the sense of being non-credal) may be addressed by resolutions of the Synod.
Option Two: A resolution declaring that the question is sufficiently important that it needs to be addressed by a 2/3 majority in each order, over two synods.

That the Council of General Synod approve the recommendation of the Pension Committee that Canon VIII be amended effective January 1, 2005 for presentation to the General Synod in 2007. The amendments are attached as Appendix 1. CARRIED #12-05-05

APPENDIX B
CANON VIII
GENERAL SYNOD PENSION AND INCOME CONTINUANCE PLANS
Amendments Effective January 1, 2005

1. Section 1.b) ix) of the Canon is amended to read as follows:
ix) "Long Term Disability Fund" means the fund described in section 2.d) of this Canon;
2. Section 2.d) of the Canon is amended to read as follows:
d) There shall be a fund established in conjunction with the Long Term Disability Plan under > written trust agreements in Canada, which funds shall be designated as the "Long Term Disability Fund of The Anglican Church of Canada", for the purposes of providing benefits in accordance with this Canon and the Long Term Disability Regulations.
The Long Term Disability Fund shall consist of the monies received by way of contributions, transfers, and other amounts for provision of Long Term Disability Plan benefits together with interest, dividends, earnings, accumulations and accretions, less the amounts expended in the payment of Long Term Disability Plan benefits and the expenses of the administration of the Long Term Disability Plan and the Long Term Disability Fund.
3. The final sentence of section 4.b) of the Canon is amended to read as follows:
b) To make and amend Regulations establishing the terms of the Pension Plan and the Long Term Disability Plan and providing for the administration thereof, subject to the approval of the Council of General Synod. These Regulations shall become effective from the date of approval by the Council of General Synod and shall remain in effect until the next session of the General Synod at which time they will cease to be in effect unless confirmed by the General Synod. The general principle to be observed when considering matters relating to the Long Term Disability Plan shall be the maintenance of a rate of contribution, paid > by Members adequate to support the benefits and the establishment of appropriate amounts reserved or retained in respect of claims, whether or not known to the Pension Committee;
4. The first clause of section 6.g) of the Canon is amended to read as follows:
g) To receive, hold and administer all funds contributed to them with respect to the long i.e. Long Term Disability Plan as a separate trust fund and in accordance with the following terms:

The Nomination Process
1. The Order of Bishops
a) In accordance with Section 13 of Canon III, the Order of Bishops will meet not earlier than 120 days and not later than 30 days before the date fixed for the election of the Primate and shall nominate three or more bishops for the office of Primate.
b) Approximately six months prior to the start of General Synod where a Primatial election will be held, the Primate (or acting Primate) will seek nominations from the Order of Bishops. Each members of the Order of Bishops shall nominate a minimum of one and a maximum of three Bishops, certifying that they have the consent of those they have nominated
c) On the day prior to the balloting the Primate (or Acting Primate) will share with the Order of Bishops the names of those who have been nominated. Additional nominations will be received until 10:00 pm. that day
d) On the day of the balloting with the Primate (or Acting Primate) presiding, a celebration of the Holy Eucharist will be held.
e) The Order of Bishops shall meet in camera without staff members.
f) The Secretary of the House of Bishops shall keep a record of the proceedings.
g) All voting shall be by secret ballot.
h) The Primate (or Acting Primate) shall appoint scrutineers from among those not nominated.
i) No bishop may abstain from voting or submit a blank ballot.
j) The names of all nominated bishops shall be listed in alphabetical order by surname.
k) On each ballot each bishop shall cast a vote for one nominated bishop.
l) When a bishop receives the votes of a majority of the Order of Bishops present, the name of that bishop shall be placed on the Nomination Report and removed from subsequent ballots
m) Balloting will continue until a minimum of three bishops have been named in the Nomination Report, and either:
- i) on motion, it is resolved that the balloting cease, or
- ii) five bishops have been named in the Nomination Report.
n) Upon receipt of a request from the Order of Clergy or the Order of Laity for further nominations during the Primatial Election, the Order of Bishops shall immediately repeat the nominating procedure and balloting will continue until one or more bishops have been named in the Nomination Report, and either:
- ii) The names of three bishops have been placed on the Nomination Report.
o) The names of bishops included in a previous nomination report shall be excluded from the nomination procedure undertaken pursuant to guideline 3n).
2. In Preparation for the Election by the Orders of Clergy and Laity
a) All candidates named on the Nomination Report must submit a police records check and any other screening material requested by the General Secretary to his/her office prior to the start of General Synod.
b) Immediately following the nomination meeting the General Secretary shall send to all members of the Orders of Clergy and Laity the names of the nominees together with the following biographical information about each nominee:
- i. Current office and location
- ii. Current photograph
- iii. List of ecclesiastical offices held
- iv. Dates of ordination as deacon, priest and bishop
- v. Other accomplishments which the nominee may wish to share (limited to 1 page)
- vi. Any personal information that the nominee may wish to share (limited to 1 page)
- vii. A statement by the nominee of his or her vision of the role of the Primate (limited to 1 page)
c) The General Secretary shall work with the Secretary of the House of Bishops to ensure that the format in which the information is communicated to the members of the Synod is standardized and that the quality of the production of the communication regarding each nominee is uniform.
Friendly amendments
The mover and seconder agreed to several friendly amendments:
1.b) Replace "Each member of the Order of Bishops shal ..." with "Members of the House of Bishops may ..."
1.m) ii) "up to five bishops have been named in the Nomination Report."
1.n) Add "immediately." ..... The House of Bishops shall immediately repeat the nominating process."

Notes
The Primate suggested that a thorough review of the primacy is needed; one that would include consultation with other primates around the communion and with Archbishop Michael Peers and himself; and also a thorough discussion with CoGS about what the church is looking for in a Primate. This work, he said, would take years.

1.4 That the Council of General Synod approve the recommendation of the Pension Committee that Section A.10 Eligible Employee of the Long Term Disability Plan be amended as follows. The effective date of these amendments is January 1, 2004.
A.10 Eligible Employee
A person employed by a Participating Employer who is below the age of 65 and who is either:
a) a member of the General synod Pension Plan or the Lay Retirement Plan of the Anglican Church of Canada; or
b) eligible to be a member of the General Synod Pension Plan of the Anglican Church of Canada, but has been exempted from membership in accordance with the provisions of that plan, provided that Coverage commences within 30 days following the person becoming eligible for Coverage.

Archbishop John Clarke introduced Ms. Bernice Logan, a former residential schools staff member, who addressed Synod and showed a video of a ten-day trip to Switzerland made by a hockey club from one of the residential schools. Archbishop Clarke said that the majority of staff members were not abusers and Synod had afforded the opportunity to ensure them a place in the history of the church.

That this General Synod recognize and acknowledge the personal sacrifice and dedication of the great majority of the teachers, supervisors and support staff who, with integrity and honour devoted so much of their lives to the education and care of the aboriginal children in the Residential Schools of Canada.
Rev. Andrew Wesley, a survivor of abuse, came forward and embrace Ms. Logan. He said he had been on a journey of forgiveness and encouraged his aboriginal people to do the same. Synod stood in acknowledgement.
Friendly Amendment
The mover and seconder agreed to add the words "including aboriginal peoples" after the words "support staff".
The amended resolution reads -
That this General Synod recognize and acknowledge the personal sacrifice and dedication of the great majority of the teachers, supervisors and support staff including aboriginal peoples who, with integrity and honour devoted so much of their lives to the education and care of the aboriginal children in the Residential Schools of Canada.

Archdeacon Jim Boyles outlined the process of advertising, interviews, etc., involved in the appointment of a new Treasurer / Director of Financial Management and Development, necessary because of Mr. Jim Cullen's impending retirement. Archdeacon Boyles reported that a candidate had been proposed to the new Primate. The Primate can make an interim appointment until November [2004], when Council can confirm it.
