That the following guidelines for the Resolutions Committee, as revised, be adopted for use at this General Synod:
It is the responsibility of the committee:
a) to receive, and prepare for debate, resolutions proposed for the consideration of the Synod;
b) to ensure that proposed resolutions contain clear and concise statements of what is intended by the sponsors;
c) to consolidate, and, if necessary, reword resolutions which deal with the same subject, after consultation with the sponsors; and
d) generally to ensure that the resolutions do not contradict the resolutions procedures which form part of these guidelines.
a) All resolutions not already printed in the convening circular, except those of a procedural or courtesy nature, or that arise in the course of debate, shall be written on the prescribed form and submitted to the Deputy Prolocutor for consideration by the committee before being put to the Synod.
b) The committee shall not debate the merits of any proposed resolution, but will ensure that it contains a clear and concise statement of what is proposed.
c) Any resolution presented to the committee may be accompanied by an explanatory note setting forth the considerations leading to the proposal. This note will not form part of the resolution.
d) No resolutions shall include any preambles (ie. "Whereas," etc. etc.).
e) The committee is authorized to consolidate and, if necessary, re-word resolutions which deal with the same subject, with the understanding that, in doing so, the committee will consult with the sponsors of the resolutions.
f) The sponsors of any resolution which is recommended for change by the committee must be consulted and asked for their agreement to change(s) proposed. If agreement cannot be reached, the committee has the authority to present its version, and the sponsors will have the opportunity to propose any amendments they believe desirable.
g) The committee may reject, or return for amendment, any resolution it considers to be:
1) outside the jurisdiction of the General Synod;
2) unclear or ambiguous;
4) of a local rather than a national character;
5) impossible of performance; or
6) calculated to be a source of embarrassment to the Church.
h) No notice of motion, except one of a procedural or a courtesy nature, will be received beyond the time stated on the agenda for the reception of notices of motion except with the consent of a two-thirds majority of the Synod.
i) Any resolution which requires the expenditure of funds, the source of which have not been identified prior to the Synod session [ROP 15(b)] must be referred by the sponsors to the Expenditures Committee.
j) Normally resolutions will be dealt with in an order which is appropriate to the elements of the agenda or in the order in which they are received. However, if time for debate is limited, the Agenda Committee will decide which resolutions will go forward for debate and which should be recommended for reference to appropriate bodies other than the Synod. ["Motions with reference to reports from Standing Committees shall take precedence over other motions on the paper." ROP 12(c).] CARRIED Act 9
That First Reading be given to the following amendments to Canon XXI:
1. That Canon XXI, On Marriage in the Church, be amended by repealing clause 3 of Part I of the Regulations and substituting therefor the following:
3. Impediments of Relationship
Nothwithstanding the Table of Kindred and Affinity contained in the Book of Common Prayer (1962), when making inquiries directed in clause 2 above the minister shall, with respect to impediments of relationship, be guided by the Marriage (Prohibited Degrees) Act which prohibits marriages between persons who are related:
a) lineally by consanguinity or adoption;
b) as brother and sister by consanguinity, whether by the whole blood or by the half-blood; or
c) as brother and sister by adoption.
2. That Canon XXI be further amended by deleting clause 17(a)(ii) of the Regulations and substituting thereof the following:
(ii) they are related to each other within the prohibited relationships set out in section 3 of Part 1 of this Canon. DEFEATED Act 19
The Hon. R. Stevenson, Chair of the Handbook Task Force, introduced the following resolution and requested a vote by orders, which was agreed to by six members of Synod.
a) That the words National Executive Council be deleted wherever they appear in the Constitution of the General Synod and that the words Council of the General Synod be substituted in each instance.
b) That the words National Executive Council be deleted wherever they appear in the Canons of the General Synod and that the words Council of the General Synod be substituted in each instance.
c) That the words National Executive Council be deleted wherever they appear in the Rules of Order and Procedure of the General Synod and that the words Council of the General Synod be substituted in each instance. CARRIED IN ALL ORDERS Act 29
That Section 47 of the Constitution be repealed and the following substituted therefor:
IX. ORGANIZATION OF THE NATIONAL STAFF
a) All staff employed by the General Synod shall be responsible to the Primate as Chief Executive Officer, for the performance of their duties.
b) The organization of the National Staff shall be under the direction of the Primate, in consultation with the Officers of the General Synod. CARRIED Act 42
Mr. Stevenson, as Chair of the Organization Committee's Handbook Task Force, extended appreciation to the members of the task force: Bishop Eric Bays (Qu'Appelle), Mr. Carl Holm (Nova Scotia), Canon Don Landon (Algoma) and Archdeacon Bud Raymond (New Westminster).
That Section 2(a) of the Constitution be deleted and the following substituted therefor:
2. Time of Meeting
a) The General Synod shall meet in every third year, or as otherwise determined by the Council of the General Synod, at such time and place as the Council of the General Synod determines, provided that such meetings are not more than five years apart. CARRIED Act 44
That Section 44 of the Constitution be repealed and the following substituted therefor:
44. Vacancies on Committees, Councils or Boards
a) Vacancies on the Council of the General Synod shall be filled in accordance with subsection f).
b) Except in the case of the Council of the General Synod, a member of a committee, council or board who ceases to be a member of the General Synod, in accordance with subsection 8(l), shall continue as a member of such committee, council or board until the ensuing session of the General Synod, unless the member dies, resigns or ceases to be a communicant member of the Anglican Church of Canada.
c) A vacancy on any committee, council, board or commission shall be deemed to exist if any member fails to attend two consecutive meetings without being excused by that committee, council, board or commission.
d) When a vacancy occurs on a committee, council or board, if the member whose position is vacant was elected to the committee, council or board by the General Synod or the Council of the General Synod, the vacancy shall be filled by the Prolocutor after consultation with the Primate.
e) When a vacancy occurs on a committee, council or board, if the member whose position is vacant was appointed to the committee, council or board by the Primate, the vacancy shall be filled by the Primate after consultation with the Prolocutor.
f) In filling vacancies on the Standing Committees of the General Synod, as defined in subsection 41(a), the Primate and Prolocutor shall observe, so far as it is practicable in their judgement, the provisions of section 41.
g) The Primate and the Prolocutor shall immediately notify the General Secretary of the General Synod of all such appointments. CARRIED Act 30
That Section 3 of the Declaration of Principles be amended by relettering subsection i) to be subsection j) and by adding a new section 3i) as follows:
i) In addition to the persons elected or appointed under subsections c) and d), there may be appointed two representatives of Anglican Religious Orders with communities in Canada recognized by the House of Bishops, such representatives to be appointed by the Superiors of the religious orders acting in concert. CARRIED Act 12
This resolution will be referred to dioceses and provinces for consideration prior to Second Reading at the next General Synod.
