"That Part I, Section 7 of Canon III be repealed and the following enacted in its place:
The Primate shall be:
a) the President of the General Synod and Chairman of the National Executive Council and Chief Executive Officer of the National staff;

Section 4 of the Declaration of Principles now reads:
4. The President
The President of the General Synod shall be the Primate of The Anglican Church of Canada, who shall be elected and hold office under, and have such privileges, powers, authority and duties as are defined by the Constitution, Canons and Rules enacted by the Synod.

a) That the phrase "provincial metropolitan senior by appointment" in Part I, Sections 2(a), 2(b) and 8(a) and Part II, Section 5(d) be amended to read "provincial metropolitan senior by election."
b) That Part I, Section 4 be amended by the addition of the words "or in accordance with the policies of" following "after consultation with."
c) That Part I, Section 5 be amended by changing the word "his" before "office" (in the second line) to "an".
d) That Part I, Section 6 be amended by changing the word "Primate" (in the second line) to "Primacy".
e) That Part I, Section 9 be amended to read: The Primate, after consultation with the other metropolitans, may, subject to satisfactory provision of financial requirements, appoint a Bishop Ordinary to the Canadian Forces.
f) That Part II, Section 3(a) be amended by the addition after "a vacancy occurring in the office of Primate" of the words "during a regular session or".
g) That Part II, Section 5(b) be amended to read:
On receipt of such nominations the clerical and lay members shall proceed forthwith to vote by ballot on such nominations. Such vote shall be taken by Orders and a majority of those present of each Order shall be necessary for election. Voting shall continue until an election results or until the clerical and lay members ask, by resolution, for additional nominations. At such time the bishops shall submit one or more additional nominations.
h) That Part II, Section 5(c) be amended by the omission in the second line of the word "members" after "clerical".
i) That a new sub-section (d) of Part II, Section 5 be enacted as follows:
No debate shall be permitted on any motion or ballot. Resolutions shall be put in writing and delivered to the Chair; and that sub-section (d) become sub-section (e). CARRIED IN ALL ORDERS by the required majority Act 41
That the following amendments to Section 6 and 7 of the Declaration of Principles be confirmed:
That Section 6(f) be amended by deleting the words `a Primate for the whole Church in Canada' and inserting in their place the words `the Primate of The Anglican Church of Canada'.
That Section 6(m) and 6(n) be deleted and the subsequent sub-sections be relettered.
That Section 7(b) be amended by reversing the order of the words `jurisdiction and authority' to make it consistent with the wording of Section 6.

That the Council of the General Synod recommend to the General Synod that it give first reading to a motion to delete sections 3, 4 and 5 from the Declaration of Principles and that the explanatory note accompanying the motion inform the members of the Synod that if and when the motion is adopted on second reading at the following session of the Synod complementary changes in the Constitution will then be proposed, viz. that
- (1) section 3 of the Constitution of the General Synod be amended to read as follows:
- 3. President and Chairperson of the General Synod
- a) The President of the General Synod shall be the Primate of The Anglican Church of Canada, who shall be elected and hold office under, and have such privileges, powers, authority and duties as are defined by the Constitution, Canons and Rules enacted by the Synod.
- b) In the absence of the Primate the archbishop senior by appointment or election or, if no archbishop is present, the bishop senior by appointment or election shall be and act as President of the Synod.
- c) The President shall be chairperson of the General Synod.
- d) In the absence, or at the request, of the President the Prolocutor shall be the chairperson of the Synod; and
(- 2) that the Constitution of the General Synod be amended by adding a new section 6 as follows:
- 6. A Unicameral Synod
The three Orders shall sit together. CARRIED #29-11-06
Members gathered in the Church of the Holy Trinity. The Holy Eucharist was celebrated with Archbishop Andrew Hutchison presiding and Archbishop Tom Morgan preaching.
Following the celebration of the Holy Eucharist, General Synod reconvened with the Prolocutor, Dean Elliott, in the Chair. The Order of Bishops withdrew. The Order of Clergy was seated on the left and the Order of Laity was seated on the right. Ballot books were distributed to clergy and lay members.
The Prolocutor appointed the following and gave instructions on the balloting procedure:

Point of Order
Mr. George Power raised a point of order with respect to the number of lay members of Synod registered to vote, as the report of the Credentials Committee listed 135 lay members and 138 lay ballots were counted. The Chancellor advised that there had been additional registrations by members after the initial report.

He thanked the scrutineers for their work.
The Prolocutor, Deputy Prolocutor and General Secretary delivered word of the election to the Order of Bishops. The Order of Bishops returned to the Church of the Holy Trinity to a standing ovation. The Primate presented Bishop Fred Hiltz and proclaimed him as the new Primate Elect. Bishop Hiltz accepted.
The Primate Elect addressed Synod and his remarks, in part, included the following:
I would like to express my appreciation to the other Primatial candidates. I will enter the Primacy with a great deal of trepidation, as it is a daunting and overwhelming task. I love this Church and I have always loved it. I pray to God that I will always give generously of myself to it. As I currently reside in the Eastern part of the country, I will need to get to know Central, Western and Northern Canada and, hopefully, I can arrange to spend plenty of time visiting the areas I do not know. I will work very hard to further the key initiatives that have already occurred in this Synod around the Church re-committing itself in wonderful ways to the Church in the North. I look forward to visiting the dioceses within the Council of the North and will do everything I can to support them.
I am a supporter of Full Communion with the ELCIC and will do my best to ensure that this relationship is deepened and nurtured at every level of the Church. I shall look forward to meeting the new National Bishop and continuing the relationship. I shall also do my best, with your help and prayers, to be a Primate who will draw the Church together, to keep members in dialogue and at the table, so that we may remain together in Christ.
My hope and prayer for our Church is that the world will be able to look at us as ‘gospel people’. Please pray for my wife and I as we prepare to leave Nova Scotia for Toronto.
The Primate Elect delivered the benediction.
The Primate, Archbishop Hutchison, thanked Synod for its work and advised that the Primate Elect would be installed as the 13th Primate of the Anglican Church of Canada in Winnipeg on June 25, 2007.
The Prolocutor thanked the Rector and parish members of the Church of the Holy Trinity for their kind generosity and hospitality.
Bishop Andrews chair of the Task Force on the Primacy gave a brief history. He reminded the House of Bishops that when it had established the task force it asked that it be made up of representatives from each of the four Ecclesiastical provinces. Members of the task force are: Bishop Andrews (Rupert's Land), Bishop Anderson (BC & Yukon), Bishop Bruce (Ontario), and Bishop Miller (Canada).
Bishop Andrews reported that each of the Anglican Church of Canada's dioceses were contacted as were some of the provinces in the Anglican Communion for their comments and input to a questionnaire about the primacy. He said that four Anglican Communion provinces had responded, and that each of them had a Primate with diocesan authority.
The task force then invited Bishop Baycroft, formerly Bishop of the Diocese of Ottawa and also Director of the Anglican Centre in Rome to write a paper on the role of the Primacy. Bishop Andrews invited Bishop Baycroft to speak.
Bishop Baycroft presented his report. He began by stating that the focus of his paper was the theology of communion. Baycroft noted that keeping the dimension of communion in mind was immensely important in the discussion. He said that the call or centre is that 'the bishop is a ministry of memory. The bishop exercises the ministry of memory. Keep it in mind at all times because it's part of what we experience in pastoral ministry". The Primate exercises ministry of memory and a ministry of synodality (walking together in Christ). Primate also serves the holiness of the communion. Should the primate also exercise a ministry of leadership in a diocese ? The model in North America (of the primate not having a dioceses) is an anomaly ? Since it's an anomaly is it limiting ?
Bishop Baycroft suggested what was being brought before the House of Bishops was a modest proposal. He also said that an alternative decision could be possible to enter into a transitional stage -- "you can in fact have the primatial see move around depending on which bishop is elected". Bishop Baycroft stated that he felt that the primate in future will need more support not less."
"Authority is a gift from God". Bishop Baycroft said, "concentrate on the word 'author'." Jurisdiction is simply being entrusted with or given the power in order to exercise the ministry. Bishop Baycroft said he didn't think the primate needed any more jurisdiction than he currently has. He added that if there is a need to say something re jurisdiction it should be clearly "spelled out".
The bishops divided into groups to discuss different questions.
Group one:
- What is the role of the Primate ?
- What changes of emphasis in, subtraction from, or additions to the role need to be made ?
Group two:
- Should the Primate continue to exercise ministry as the Bishop of a Diocese ?
- Should the House recommend a resolution to General Synod placing in abeyance Canon iii 3b requiring the Primate elect to resign his or her diocese ?
Group three:
- What needs to be clarified about the authority of the Primate ?
- What needs to be clarified about jurisdiction ?
The groups reported back in plenary. Bishop Baycroft said that the bishop appeared to be ready to address the proposed motions.

That this House of Bishops request General Synod 2007 to establish a Task Force composed of members of the Orders of Bishops, Clergy and Laity to undertake a detailed and comprehensive study of the nature, role, duties and authority of the Primate including, if necessary, suggested changes to Canon III for consideration by General Synod 2010. Archbishop Hutchison said that he was pleased that the bishops had decided to allow time for studying an issue which would have important implications. He also said that as Primate, he had enjoyed not having jurisdiction with respect to legal matters in a diocese, except for those affecting the national office. He informed the bishops that if the Primate maintained diocesan jurisdiction then the Primate would also be in canonical obedience to one of the metropolitans.
