That Canon III be amended as follows:
a) That the phrase "provincial metropolitan senior by appointment" in Part I, Sections 2(a), 2(b) and 8(a) and Part II, Section 5(d) be amended to read "provincial metropolitan senior by election."
b) That Part I, Section 4 be amended by the addition of the words "or in accordance with the policies of" following "after consultation with."
c) That Part I, Section 5 be amended by changing the word "his" before "office" (in the second line) to "an".
d) That Part I, Section 6 be amended by changing the word "Primate" (in the second line) to "Primacy".
e) That Part I, Section 9 be amended to read: The Primate, after consultation with the other metropolitans, may, subject to satisfactory provision of financial requirements, appoint a Bishop Ordinary to the Canadian Forces.
f) That Part II, Section 3(a) be amended by the addition after "a vacancy occurring in the office of Primate" of the words "during a regular session or".
g) That Part II, Section 5(b) be amended to read:
On receipt of such nominations the clerical and lay members shall proceed forthwith to vote by ballot on such nominations. Such vote shall be taken by Orders and a majority of those present of each Order shall be necessary for election. Voting shall continue until an election results or until the clerical and lay members ask, by resolution, for additional nominations. At such time the bishops shall submit one or more additional nominations.
h) That Part II, Section 5(c) be amended by the omission in the second line of the word "members" after "clerical".
i) That a new sub-section (d) of Part II, Section 5 be enacted as follows:
No debate shall be permitted on any motion or ballot. Resolutions shall be put in writing and delivered to the Chair; and that sub-section (d) become sub-section (e). CARRIED IN ALL ORDERS by the required majority Act 41

That the Council of the General Synod recommend to the General Synod that it give first reading to a motion to delete sections 3, 4 and 5 from the Declaration of Principles and that the explanatory note accompanying the motion inform the members of the Synod that if and when the motion is adopted on second reading at the following session of the Synod complementary changes in the Constitution will then be proposed, viz. that
- (1) section 3 of the Constitution of the General Synod be amended to read as follows:
- 3. President and Chairperson of the General Synod
- a) The President of the General Synod shall be the Primate of The Anglican Church of Canada, who shall be elected and hold office under, and have such privileges, powers, authority and duties as are defined by the Constitution, Canons and Rules enacted by the Synod.
- b) In the absence of the Primate the archbishop senior by appointment or election or, if no archbishop is present, the bishop senior by appointment or election shall be and act as President of the Synod.
- c) The President shall be chairperson of the General Synod.
- d) In the absence, or at the request, of the President the Prolocutor shall be the chairperson of the Synod; and
(- 2) that the Constitution of the General Synod be amended by adding a new section 6 as follows:
- 6. A Unicameral Synod

Prologue
Members gathered in the Church of the Holy Trinity. The Holy Eucharist was celebrated with Archbishop Andrew Hutchison presiding and Archbishop Tom Morgan preaching.
Following the celebration of the Holy Eucharist, General Synod reconvened with the Prolocutor, Dean Elliott, in the Chair. The Order of Bishops withdrew. The Order of Clergy was seated on the left and the Order of Laity was seated on the right. Ballot books were distributed to clergy and lay members.
The Prolocutor appointed the following and gave instructions on the balloting procedure:

Point of Order
Mr. George Power raised a point of order with respect to the number of lay members of Synod registered to vote, as the report of the Credentials Committee listed 135 lay members and 138 lay ballots were counted. The Chancellor advised that there had been additional registrations by members after the initial report.

He thanked the scrutineers for their work.
The Prolocutor, Deputy Prolocutor and General Secretary delivered word of the election to the Order of Bishops. The Order of Bishops returned to the Church of the Holy Trinity to a standing ovation. The Primate presented Bishop Fred Hiltz and proclaimed him as the new Primate Elect. Bishop Hiltz accepted.
The Primate Elect addressed Synod and his remarks, in part, included the following:
I would like to express my appreciation to the other Primatial candidates. I will enter the Primacy with a great deal of trepidation, as it is a daunting and overwhelming task. I love this Church and I have always loved it. I pray to God that I will always give generously of myself to it. As I currently reside in the Eastern part of the country, I will need to get to know Central, Western and Northern Canada and, hopefully, I can arrange to spend plenty of time visiting the areas I do not know. I will work very hard to further the key initiatives that have already occurred in this Synod around the Church re-committing itself in wonderful ways to the Church in the North. I look forward to visiting the dioceses within the Council of the North and will do everything I can to support them.
I am a supporter of Full Communion with the ELCIC and will do my best to ensure that this relationship is deepened and nurtured at every level of the Church. I shall look forward to meeting the new National Bishop and continuing the relationship. I shall also do my best, with your help and prayers, to be a Primate who will draw the Church together, to keep members in dialogue and at the table, so that we may remain together in Christ.
My hope and prayer for our Church is that the world will be able to look at us as ‘gospel people’. Please pray for my wife and I as we prepare to leave Nova Scotia for Toronto.
The Primate Elect delivered the benediction.
The Primate, Archbishop Hutchison, thanked Synod for its work and advised that the Primate Elect would be installed as the 13th Primate of the Anglican Church of Canada in Winnipeg on June 25, 2007.
The Prolocutor thanked the Rector and parish members of the Church of the Holy Trinity for their kind generosity and hospitality.

Bishop Andrews chair of the Task Force on the Primacy gave a brief history. He reminded the House of Bishops that when it had established the task force it asked that it be made up of representatives from each of the four Ecclesiastical provinces. Members of the task force are: Bishop Andrews (Rupert's Land), Bishop Anderson (BC & Yukon), Bishop Bruce (Ontario), and Bishop Miller (Canada).
Bishop Andrews reported that each of the Anglican Church of Canada's dioceses were contacted as were some of the provinces in the Anglican Communion for their comments and input to a questionnaire about the primacy. He said that four Anglican Communion provinces had responded, and that each of them had a Primate with diocesan authority.
The task force then invited Bishop Baycroft, formerly Bishop of the Diocese of Ottawa and also Director of the Anglican Centre in Rome to write a paper on the role of the Primacy. Bishop Andrews invited Bishop Baycroft to speak.
Bishop Baycroft presented his report. He began by stating that the focus of his paper was the theology of communion. Baycroft noted that keeping the dimension of communion in mind was immensely important in the discussion. He said that the call or centre is that 'the bishop is a ministry of memory. The bishop exercises the ministry of memory. Keep it in mind at all times because it's part of what we experience in pastoral ministry". The Primate exercises ministry of memory and a ministry of synodality (walking together in Christ). Primate also serves the holiness of the communion. Should the primate also exercise a ministry of leadership in a diocese ? The model in North America (of the primate not having a dioceses) is an anomaly ? Since it's an anomaly is it limiting ?
Bishop Baycroft suggested what was being brought before the House of Bishops was a modest proposal. He also said that an alternative decision could be possible to enter into a transitional stage -- "you can in fact have the primatial see move around depending on which bishop is elected". Bishop Baycroft stated that he felt that the primate in future will need more support not less."
"Authority is a gift from God". Bishop Baycroft said, "concentrate on the word 'author'." Jurisdiction is simply being entrusted with or given the power in order to exercise the ministry. Bishop Baycroft said he didn't think the primate needed any more jurisdiction than he currently has. He added that if there is a need to say something re jurisdiction it should be clearly "spelled out".
The bishops divided into groups to discuss different questions.
Group one:
- What is the role of the Primate ?
- What changes of emphasis in, subtraction from, or additions to the role need to be made ?
Group two:
- Should the Primate continue to exercise ministry as the Bishop of a Diocese ?
- Should the House recommend a resolution to General Synod placing in abeyance Canon iii 3b requiring the Primate elect to resign his or her diocese ?
Group three:
- What needs to be clarified about the authority of the Primate ?
- What needs to be clarified about jurisdiction ?
The groups reported back in plenary. Bishop Baycroft said that the bishop appeared to be ready to address the proposed motions.

Archbishop Hutchison said that he was pleased that the bishops had decided to allow time for studying an issue which would have important implications. He also said that as Primate, he had enjoyed not having jurisdiction with respect to legal matters in a diocese, except for those affecting the national office. He informed the bishops that if the Primate maintained diocesan jurisdiction then the Primate would also be in canonical obedience to one of the metropolitans.

CANON III
- The Primacy
1. The Primacy
a) There shall be a Primate who shall be the presiding bishop of The Anglican Church of Canada.
b) The Primate, upon assuming office, shall be the Senior Metropolitan of The Anglican Church of Canada.
c) The Primate shall have the title .Archbishop.
2. Election to the Primacy
The Primate shall be elected in accordance with the procedures established in part II of this Canon.
> . Term of Office
a) The term of office of the Primate shall commence upon installation to the office.
b) As soon as practicable following election, but in any case not more than 90 days after the date of election, the Primate shall resign the any Episcopal or and Metropolitical offices held at the time of election to the Primacy.
c) The Primate shall hold office until:
i) attaining 70 years of age, or
ii) the effective date of a resignation accepted pursuant to section > b) of this Canon, or
iii) the adoption of a resolution declaring the Primacy vacant pursuant to section > d) of this Canon.
>
b) The Primate may, after consultation with the Provincial Metropolitans and the Chapter of the Anglican Military Ordinariate and subject to the provisions of financial requirements, appoint a Bishop Ordinary who shall have episcopal jurisdiction over the chaplains of The Anglican Church of Canada on duty with the Canadian Forces
> . The Office of the Primate
a) The Primate shall maintain an office at the headquarters of the General Synod of The Anglican Church of Canada.
b) The Primate may retain personal assistants after appropriate financial arrangements have been made pursuant to sections > c) and > d) of this Canon.
c) The Financial Management > Committee shall, in accordance with its budgeting procedures, determine the financial needs of the Primacy, including all salaries, office expenses, living allowances, travel expenses, entertainment allowances and other expenses.
d) The financial needs of the Primacy shall be met first from the income of any capital fund designated for such purpose and, second, from the proportional gifts that are made by the dioceses.
> . Acting Primate
During a vacancy in the Primacy or during the incapacity of the Primate, the Provincial Metropolitan senior by election, able and willing to act, shall have authority to perform all the duties of the Primacy and shall be styled .Acting Primate.
> . Resignation from Office
a) The Primate may submit notice of intention to resign from the office of Primate to the Provincial Metropolitan senior by election.
b) The > Metropolitan shall, after consultation with the other Metropolitans and with the Prolocutor and Deputy Prolocutor of the General Synod, jointly with the Primate determine the date on which the Primate‘s resignation should take effect.
c) The Primate shall then submit to the > Metropolitan , and the > Metropolitan shall accept, a resignation to take effect on the date determined pursuant to section 9 b).
d) The > Metropolitan shall report the resignation to the Council of the General Synod and to the Order of Bishops of the General Synod.
e) The title of the Primate after ceasing to hold office shall continue to be .Archbishop.
> . Incapacity of the Primate
a) The incapacity of the Primate to carry out the functions of the Primacy for reason of illness or otherwise shall be established:
- i) by the deed of the Primate to that effect addressed to the Provincial Metropolitan senior by election, or
- ii) by a Certificate of Incapacity addressed to the Provincial Metropolitan senior by election, and signed by four Diocesan Bishops of The Anglican Church of Canada and one of:
--a) The Provincial Metropolitans,
-- b) The Chancellor of the General Synod, or
-- c) The Prolocutor of the General Synod.
b) Where the incapacity of the Primate has been established by the deed of the Primate to that effect, the Primate may resume the functions of the Primacy by giving notice of intention to do so to the Acting Primate.
c) Where the incapacity of the Primate has been established by a Certificate of Incapacity, the Primate may resume the functions of the Primacy by giving to the Acting Primate notice of intention to do so, and
- i) a certificate establishing the capacity of the Primate to resume the functions of the Primacy, signed by the persons who signed the Certificate of Incapacity, or their successors in office, or
- ii) a certified copy of a resolution of the Council of the General Synod, or of the General Synod, directing that the Primate may resume the functions of the Primacy.
d) After the incapacity of the Primate to carry out the functions of the Primacy, has been established under section 8 10 a) of this Canon, the Primacy may be declared vacant:
- i) by special resolution of each of the Council of the General Synod and the Order of Bishops, or
- ii) by special resolution of the General Synod.
II - Election Procedures
> . Procedural Guidelines
The Council of the General Synod shall establish procedural guidelines for the conduct of the election of a Primate but this Canon shall have precedence over anything contained in the guidelines as established.
> . Eligibility
All bishops of The Anglican Church of Canada who are members of the Order of Bishops of the General Synod in accordance with the Constitution of the General Synod shall be eligible for election to the Primacy.
> 13. General Synod to Elect
The Primate shall be nominated and elected by the General Synod of The Anglican Church of Canada in accordance with this Canon.
> . Time of Election
a) Where a vacancy in the Primacy occurs less than 12 months before a regular session of the General Synod, the General Synod shall elect a Primate during such regular session at a time fixed by the Acting Primate.
b) Where a vacancy occurs more than 12 months before a regular session of the General Synod, unless the Council of the General Synod directs otherwise, the General Synod shall elect a Primate at a special session held at a time and place fixed by the Acting Primate in consultation with the Council of the General Synod.
> . Meeting of the Order of Bishops
The Order of Bishops shall meet not earlier than one hundred and twenty days and not later than thirty days before the date fixed for the election of the Primate and shall nominate three or more bishops for the office of Primate.
> . Notice to the Orders of Clergy and Laity
Immediately following the meeting of the Order of Bishops, the General Secretary of the General Synod shall send to all members of the Orders of Clergy and Laity the names of the nominees together with such biographical information about each nominee as is required by the guidelines established under section 9 11.
> . President
The Prolocutor of the General Synod or, in the absence of the Prolocutor, the Deputy Prolocutor shall preside during the election of the Primate by the General Synod.
> . Celebration of Holy Communion
On the day appointed for the election, the General Synod shall convene for a celebration of Holy Communion.
> . Report of the Credentials Committee
Upon conclusion of the celebration of Holy Communion, the Credentials Committee shall report as to the standing of all persons present and as to the presence of a quorum of the General Synod.
> . Withdrawal of the Order of Bishops
A quorum of the General Synod being present, the Order of Bishops shall withdraw and sit apart from the other Orders.
> . Voting and Election in the Orders of Clergy and Laity
a) When the Order of Bishops has withdrawn, the Orders of Clergy and Laity shall proceed immediately to vote by ballot on the nominations made by the Order of Bishops.
b) Votes shall be taken by Orders and, subject to sections > and > , shall continue until there is an election.
c) After the second and each subsequent vote:
i) the name of any nominee who has received fewer than 10 per cent of the votes cats in the Order of Clergy and fewer than 10 per cent of the votes cast in the Order of Laity, or
ii) if all nominees have received at least 10 per cent of the votes in both Orders, the name of the nominee who received the fewest votes in the aggregate, shall be removed from the ballot before the next vote, until only two nominees remain.
d) An election occurs when a nominee receives a majority of the votes of:
i) the members of the Order of Clergy present, and
ii) the members of the Order of Laity present.
e) Upon an election occurring, the Order of Bishops shall be notified.
> . Further Nominations
a) Either the Order of Clergy or the Order of Laity may, at any time after the second vote is taken, by resolution request further nominations from the Order of Bishops.
b) Upon receipt of such a request, the Order of Bishops shall submit one or more additional nominations.
> . Resolutions
a) resolutions shall be presented in writing to the President.
b) No debate shall be permitted on any resolution or ballot.
> . Failure of Orders of Clergy and Laity to Elect
a) When, after the number of nominees has been reduced to two,
i) an election has not occurred after three successive votes, and
ii) no request for additional nominations has been made, the Order of Bishops shall be notified that the Orders of Clergy and Laity are unable to elect.
b) When the Order of Bishops is notified that the Orders of Clergy and Laity are unable to elect, the members of the order of Bishops shall proceed to vote on the two remaining nominees and an election occurs when one of the nominees receives a majority of the votes of the members of the Order of Bishops present.

When an election occurs, the Order of Bishops shall return and sit with the Order of Clergy and Laity and >

That this General Synod amend the Constitution of the General Synod as follows:
- 1) by amending section 13 b) to read:
-- b) The Primate shall be President of the General Synod, chairperson of the Council of the General Synod.> In the event of the inability of the Primate to act as the President or chairperson, the provincial metropolitan senior by election, or if none be present, the diocesan bishop senior by appointment or election, shall act.
- 2) by amending section 16 c) to read:
-- c) Under the direction of the Primate the General Secretary shall:
--- i) > of the General Synod>;
--- ii) make the necessary arrangements for meetings of the General Synod and Council of the General Synod and act as secretary of both bodies;
--- iii) perform such other duties as are defined by the Constitution, Rules of Order and Procedure, Canons and resolutions of the General Synod or the Council of the General Synod.;
- 3) by amending section 16 e) to read:
e) The General Secretary shall be assistant to the Primate in the Primate‘s capacity as President of the General Synod >.
- 4) by amending section 45 to read:
